UK Divorce Law

It is never a good thing to be involved in a legal dispute. All legal disputes concerning Family Law involve a host of sensitive issues such as divorce law and legal separation, adoption, custody of children, child protection, support of children, domestic abuse and the settlement of financial disputes that might have arisen out of divorce, separation or some other family-related legal issue.

Divorce Law May Be An Exception

While the law only recognizes cases wherein a divorce issue has arisen out of the common grounds for divorce under UK’s divorce law, more and more people nowadays are clamoring for a no-fault divorce statute to be implemented in the UK. A no-fault divorce like the one that is in effect in the US would basically allow couples who wish to end their marriage on friendly terms and without actually blaming the other person for the failure of the relationship to terminate the marriage amicably. Current UK laws on divorce do not allow this, unfortunately. There are only  five ways to divorce in the UK and while there exists a consensual form of divorce, it still requires 2 years on minimum. Here are the grounds as enumerated by UK divorce law:

  • Unreasonable behaviour.
  • 2 years separation with consent.
  • 5 years separation (no consent required)

Of course, the reality is that there are still a lot of people who want to divorce quickly, which is why “unreasonable behavior” is the legal loophole that couples who wish to divorce amicably often turn to in order to perpetuate their divorce with the help of a Divorce Law solicitor. Most often, what really happens is that the lawyer sets up the ground for unreasonable behavior by blaming one of the parties to the divorce using a claim that is irrelevant enough to be ignored by most people, but at least relevant enough to be taken cognizance of by the court. Unfortunately, while there is still no law that allows for no-fault divorce in the UK, this is the best that can be done. Therefore, divorce is most likely one of the few exceptions wherein a legal dispute can actually be resolved with few complications.

Property Regime Post Divorce

After a divorce, there is no actual property regime and it is actually left to the discretion of the courts as to what happens to the properties of the spouses. This is why it is important to get professional legal assistance in order to ensure that you don’t get the short end of the stick and that your rights are properly protected.

Get A Solicitor Who Actually Cares

Because of the sensitive nature of family legal issues in the UK, it is very important that you choose a family lawyer who can not only understand the actual legal issues that surround your case and provide you with an expert opinion, it is also of tantamount importance that you choose a solicitor who can empathize with your situation while maintaining a professional demeanor and providing you with the best options available for you in divorce law at the least possible cost.
