What are the grounds for divorce?
Keep in mind that the grounds for divorce can vary wildly across different territorial jurisdictions. This means that divorce is different depending on the law in effect in your area. However, as far as the UK is concerned, there are only these grounds available for divorce:
- The Respondent has committed adultery and the petitioner finds it intolerable to live with the Respondent.
- The Respondent has behaved in such a way that the petitioner cannot reasonably be expected to live with the Respondent.
- The Respondent has deserted the petitioner for a continuous period of at least two years immediately before the start of the divorce.
- You have lived apart for a continuous period of at least two years immediately before the start of the divorce and the Respondent consents to a decree being granted.
- You have lived apart for a continuous period of at least five years immediately before the start of the divorce.

Whether or not the case reaches the litigation stage is really quite situation. It is all based on a case to case basis depending on a number of different factors. Be careful as some lawyers will only accept an hourly rate or vice versa.
